Terms of Service
These terms are the agreement between you and Vista Site Selection, LLC (“Vista”, “we”, “us”) for using VSSGEO, including the map, Geo (VSSGEO’s AI assistant), reports, exports and any VSSGEO API. By creating an account, or by buying a plan or credits, you agree to these terms, the Privacy Policy and the Refund Policy.
The short version
- VSSGEO is a research tool. Its maps, numbers and AI answers can be wrong or out of date. Check anything important before you rely on it.
- Vista is not a law firm, and nothing in VSSGEO is legal, tax, financial, engineering or real-estate advice.
- You pay in credits. A credit is one cent. The app shows what things cost, and your receipts show what you used. Credits have no cash value.
- Plans renew monthly until you cancel. You can cancel any time, and the plan runs to the end of the month you paid for.
- Your questions, files and projects are yours. We use them to run VSSGEO for you, and we don’t sell them.
- Don’t use VSSGEO to discriminate against people, to make decisions about individuals, or to copy our data in bulk.

1. Who we are, and who can use VSSGEO
VSSGEO is provided by Vista Site Selection, LLC, 52 East Gay Street, Columbus, Ohio 43215. Vista is majority-owned by Vorys, Sater, Seymour and Pease LLP. Vista is a separate company, is not a law firm, and does not provide legal advice or legal services.
VSSGEO is for business and professional use. To create an account you must be at least 18 and able to enter a binding contract. If you use VSSGEO for a company or other organization, you confirm that you may accept these terms for it, and “you” includes that organization.
2. What VSSGEO is
VSSGEO helps you study places: who lives and works there, the businesses around them, hazards, and sites for sale or lease. It puts that information on a map and in reports. Geo, VSSGEO’s AI assistant, answers questions, builds maps and writes files from the data VSSGEO holds.
That data comes mostly from public sources, such as the U.S. Census Bureau, the Bureau of Labor Statistics, CDC, FEMA, EPA, USDA, HUD, the IRS and state transportation departments. Other sources include open map and place data (OpenStreetMap, Overture Maps) and commercial property listings. Much of it is estimated, modelled or allocated to small areas. Our own neighborhood groups, scores and recommendations are analytical products, not facts about any person or property. Geo’s answers are generated by AI, and they can be incomplete or wrong even when the data behind them is right.
3. Not professional advice
VSSGEO gives you information for your own research and decisions. It does not give legal, tax, accounting, financial, investment, lending, insurance, engineering, environmental, appraisal, zoning or real-estate brokerage advice. Nothing in VSSGEO creates an attorney-client relationship with Vista or with Vorys, Sater, Seymour and Pease LLP. In particular:
- Incentive estimates are indicative only. Whether a project qualifies, and for how much, is decided by the program and the government that runs it.
- Flood-zone and hazard information is not an official flood determination, survey, title, environmental or zoning review.
- Store locations, listings, wages and counts can be missing, duplicated or out of date.
Before you commit money, sign a lease or buy a site, confirm what matters with the original source and with qualified professionals.
4. Your account
- Give accurate sign-up details and keep your email address current. We use it for receipts, security and password resets.
- An account is for one person. Don’t share your sign-in. You are responsible for what happens under your account, and for keeping your password and any API keys safe. Tell us at once if you think someone else has used them.
- The free trial is for one account per person and one per organization. Creating extra accounts to get more free credits isn’t allowed. We may remove credits gained that way and close the extra accounts.
- You can close your account at any time under Account → Password & security. What happens to your information then is in the Privacy Policy.
5. Credits, plans and payment
Credits
- VSSGEO runs on one balance of credits. When you buy them, one credit costs one U.S. cent.
- Credits pay for work in VSSGEO. A report area costs a fixed number of credits on each plan. AI work, such as Geo’s answers, maps, story heat maps, reports and files, uses credits according to the amount of work each request takes, at your plan’s rate. Higher plans use fewer credits for the same work.
- The app shows current prices and typical costs. Before larger jobs, Geo tells you the expected cost and asks first. Your receipts and the Usage view show what you used.
- Reopening something you already ran (a map, a report, an answer, a shared link) is free.
- Credits are not money. They have no cash value, can’t be transferred, sold or exchanged, and are refunded only under the Refund Policy.
- The free trial (Plankton) is 1,000 credits, once: 100 when you sign up and 900 more when you confirm your email address. If you sign up with Google, your email is already confirmed.
- Each paid plan includes a monthly amount of credits for each month you pay for. Those are used first, and unused monthly credits do not carry into the next month. Credits you buy separately do not expire while your account is open. Free, trial and promotional credits can be withdrawn if they were obtained against these terms.
- We may change prices, credit costs and plan contents. A change that raises what you pay applies to requests made after it is posted. For your subscription price, we give at least 30 days’ notice by email, and you can cancel before it applies.
Plans and billing
- Paid plans are monthly subscriptions, billed in advance in U.S. dollars. Payments are processed by Stripe; we never see or store your full card number.
- Your plan renews automatically each month until you cancel, and you authorize us, through Stripe, to charge your payment method at each renewal.
- Upgrades take effect right away. You pay the prorated difference for the rest of the month and get the extra credits for it. Downgrades take effect at the start of your next month.
- Cancelling: you can cancel at any time in Account → Plan or in the billing portal. The plan and its credits last until the end of the month you paid for, and it isn’t renewed after that.
- If a payment fails, Stripe retries it. Your monthly credits refill once the payment goes through. If we can’t collect payment, we may move your account to the free plan.
- Prices exclude taxes unless the app says otherwise. We charge sales or similar taxes where the law requires us to.
- If your organization has a separate written agreement or order form with Vista, that agreement governs where it differs from these terms.
6. Your content
“Your content” means what you put into VSSGEO: questions, stories, areas you draw, files you upload, notes, the shops you add, property listings you submit, and your messages to us. It also includes the outputs made for you from it.
- You own your content. You give Vista a worldwide, non-exclusive, royalty-free licence to host, copy, process, analyze and display it, to the extent needed to run VSSGEO for you, to keep it secure, and to support you.
- We also use records of how VSSGEO is used to improve it. When we use them beyond running your account, they are de-identified or combined with others. We don’t sell your content, and we don’t publish it unless you choose to share it.
- Geo keeps notes on your projects to personalize its answers, as described in the Privacy Policy. You can turn this off in Settings at any time. Patterns we learn across users to improve Geo never include your content or anything that identifies you.
- To answer you, VSSGEO sends your questions and the relevant data to the service providers named in the Privacy Policy, including our AI provider. Those providers process it on our behalf.
- Sharing: anyone with a view link you create can see the session it opens, until you turn the link off. People you invite to edit a session can change it, and their AI work uses their own credits unless you choose to cover it with yours. A property listing you publish is visible to other VSSGEO users.
- Only upload content you have the right to use. Don’t upload other people’s personal information, or confidential information you aren’t allowed to share. You are responsible for your content, and for the decisions you make with VSSGEO’s outputs.
- If you publish a property listing, you confirm that you are allowed to market the property and that the listing is accurate. We may edit its formatting, or remove it.
7. Data, outputs and licences
- You may use the maps, reports, spreadsheets and other outputs VSSGEO makes for you in your business. That includes sharing them with your colleagues, clients and advisers.
- Keep the attributions. Some data comes with licence terms, including the Open Database License (OpenStreetMap), CC BY 4.0 (O*NET) and CDLA-Permissive-2.0 (Overture Maps). VSSGEO adds a sources and licences page to its files, and the credit lines on the map; leave them in place when you share.
- Property listings belong to their brokers and sources. Use them to find and contact the listing party, and follow any terms the listing carries.
- You may not resell or redistribute VSSGEO’s data as a dataset, or use VSSGEO to build a competing product, database or model.
8. Acceptable use
When you use VSSGEO, you agree to follow the law and these rules. Don’t:
- discriminate. Don’t use VSSGEO to deny, limit or steer housing, credit, insurance, employment or services on the basis of race, color, national origin, religion, sex, familial status, disability, age or any other protected characteristic, or in any other way that breaks fair housing, fair lending or civil rights laws. Demographic information in VSSGEO describes areas; use it lawfully.
- make decisions about individual people. VSSGEO is not a consumer reporting agency, and its information may not be used to decide any person’s eligibility for credit, insurance, housing or employment.
- copy VSSGEO in bulk. That means scraping, crawling, harvesting or bulk downloading VSSGEO, or reaching it by automated means other than an API or keys we give you.
- get around the rules. Don’t reverse engineer VSSGEO, interfere with it, test its security without our written permission, or get around its limits, credit charges or access controls.
- farm free credits. Don’t create accounts, or use other people’s, to get more free credits.
- misuse the AI. Don’t use Geo to make unlawful, harassing, deceptive or infringing material, or try to make it reveal information it isn’t meant to.
- upload harmful content. Don’t upload malware, or content you have no right to share.
- mislead or break trade laws. Don’t impersonate anyone or misrepresent your connection to anyone, and don’t use VSSGEO in breach of U.S. export control or sanctions laws.
9. Our property
VSSGEO belongs to Vista or its licensors, and these terms don’t transfer any of it to you. That includes the software, designs, maps, neighborhood groups, scores, text, images, the Geo character, and the names VSSGEO and Vista Site Selection. While your account is in good standing, you may use VSSGEO as these terms allow. If you send us ideas or feedback, we may use them freely and owe you nothing for them.
10. Third-party services
VSSGEO relies on other companies’ services, including Stripe for payments, Google for Sign in with Google and address search, and map and data providers. Their own terms apply to what they provide, and we aren’t responsible for their services. Links to other websites, such as broker listings, are for convenience only.
11. Changes to VSSGEO
We improve VSSGEO all the time, and we may add, change or remove features and data. Features marked beta or preview may change or end without notice. We aim to keep VSSGEO available, but we don’t promise that it will always be available or free of errors, unless a separate agreement with your organization says so.
12. Suspension and closing
- You may stop using VSSGEO and close your account at any time.
- We may suspend or close an account, or limit what it can do, in any of these cases:
- it breaks these terms;
- it doesn’t pay;
- it puts VSSGEO, other users or anyone else at risk;
- the law requires us to.
- When an account is closed, access ends and unused credits end with it, except as the Refund Policy provides. Sections 5 (amounts owed), 6, 7 and 9 to 18 continue to apply after closing.
13. Disclaimers
VSSGEO, its data, its AI outputs and everything in it are provided “as is” and “as available”. To the fullest extent the law allows, Vista disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy and completeness. Vista does not warrant that VSSGEO will be uninterrupted, secure or error-free, or that any result will be achieved. You use VSSGEO, and act on its outputs, at your own risk.
14. Limits on liability
To the fullest extent the law allows, Vista and its owners, officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, business, data or goodwill, arising from or related to VSSGEO or these terms, even if advised that they were possible. Vista’s total liability for all claims arising from or related to VSSGEO or these terms is limited to the greater of (a) the amounts you paid Vista for VSSGEO in the 12 months before the event giving rise to the claim, and (b) US $100.
Some places don’t allow some of these limits. Where they don’t, the limits apply as far as the law there permits.
15. Indemnity
You will defend and indemnify Vista, and its owners, officers and employees, against claims, losses and costs (including reasonable legal fees) that arise from your content, from your use of VSSGEO or its outputs in breach of these terms or the law, or from your violation of anyone’s rights.
16. Governing law and disputes
These terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws rules. Before filing a claim, each side agrees to try to resolve the dispute informally for 30 days, starting from written notice; you can send yours to [email protected]. If that doesn’t resolve it, the state and federal courts located in Franklin County, Ohio have exclusive jurisdiction, and both sides consent to them. Either side may seek urgent relief in any court that has jurisdiction, to protect its intellectual property or confidential information.
17. Changes to these terms
We may update these terms. When we do, we post the new version here with a new date. For material changes, we tell you by email or in VSSGEO before they take effect, and we may ask you to accept them before you continue or make a purchase. If you continue to use VSSGEO after the effective date, you accept the new terms. If you don’t agree, stop using VSSGEO and close your account.
18. General
- These terms are the whole agreement between you and Vista about VSSGEO, together with the Privacy Policy, the Refund Policy and any written agreement or order form with your organization.
- You agree to receive notices and communications from us electronically, by email or in VSSGEO.
- You may not transfer these terms without our written consent. We may transfer them as part of a merger, acquisition or sale of assets.
- If a court finds any part of these terms unenforceable, the rest stays in effect. If we don’t enforce a right, we haven’t waived it.
- Neither side is responsible for delays caused by events beyond its reasonable control.
